At approximately 10:45 p.m. at July 7, 2020, emergency services personnel (Police Fire, EMS) responded to the area of Lakeshore Road and Camelot Drive in Wainfleet for a report of a single-vehicle rollover.
6 District (Port Colborne) uniform officers arrived on scene and found a 2005 grey Dodge Ram pickup truck on its roof with two people inside. The two males were extricated from the pickup truck by members of the Wainfleet Fire Services. One of the passengers, a 25-year-old man from Port Colborne was pronounced deceased at the scene. A second passenger, a 21 year-old-man from Port Colborne was transported to a local hospital by paramedics from Niagara Emergency Medical Services with life-threatening injuries. The man was subsequently transported to an out of region hospital for further care.
The driver was located on scene and treated by paramedics from Niagara Emergency Medical Services for his minor injuries. He was transported to a local hospital.
Detectives from the Niagara Regional Police Service (NRPS) Collision Reconstruction Unit took over the investigation and were assisted by the NRPS Forensic Services Unit and Traffic Enforcement Unit. Detectives determined that the pickup truck had been travelling on Lakeshore Road when if left the roadway striking a tree and rolling over.
The driver of the pickup truck Brocque John Cote (20 years old) of Port Colborne has been arrested and charged with the alleged criminal offences of:
- Impaired Operation of a Conveyance cause Death contrary to section 320.14(3)(1)
- Impaired Operation of a Conveyance cause Bodily Harm contrary to section 320.14(2)(1)
- Impaired Operation of a Conveyance exceed Blood Alcohol concentration contrary to section 320.14(1)(B)
Upon being medically cleared at the hospital, Cote was transported by officers to the NRPS Prisoner Management Unit to be held pending a bail hearing. Cote will appear via video link on today's date at the Robert S. K. Welch Courthouse in St. Catharines.
Cote has been issued an Administrative Driver's Licence Suspension (ADLS). The ADLS, is issued to everyone charged with similar driving offences.The ADLS prohibits him from operating a motor vehicle for 90 days from date it was issued.
The identity of the deceased is not being released out of respect for the next of kin.
